These Terms of Service ("Terms") govern your use of the Fixr mobile application and website operated by Getfixr (PTY) LTD ("Getfixr", "we", "us", "our"). By creating an account or using the Fixr platform in any way, you agree to be bound by these Terms in full. If you do not agree, do not use the platform.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under South African law to use Fixr. By registering, you confirm that you meet these requirements. We may request proof of age or identity at any time.

2. The Fixr Platform

Fixr is a technology marketplace that enables customers to post jobs and receive quotes from independent tradespeople ("Fixrs"). We provide the software, infrastructure, and tools that facilitate this connection. We do not:

• Perform any trade or home services ourselves
• Supply, recommend, or guarantee any particular Fixr
• Control the manner, timing, or quality in which a Fixr performs work
• Act as an agent or partner of any Fixr

The contract for any job is solely between the customer and the Fixr. Getfixr is not a party to that agreement.

3. Independent Contractor Relationship

Fixrs who access the platform are independent contractors operating their own businesses. They are not employees, sub-contractors, agents, or partners of Getfixr in any respect. Getfixr:

• Does not direct or supervise how Fixrs perform work
• Does not set Fixr rates, hours, or working conditions
• Does not provide Fixrs with tools, equipment, or materials
• Is not vicariously liable for the acts, omissions, or negligence of any Fixr

Each Fixr is responsible for their own tax compliance, insurance, licensing, and legal obligations under South African law.

4. Vetting and Verification

We conduct identity verification, criminal background screening, and bank account verification on Fixrs before they are permitted to accept jobs. This vetting is a reasonable precaution but does not constitute a guarantee or warranty of any kind. In particular:

• Vetting confirms identity and screens historical records — it does not predict future conduct
• Trade qualifications and licences are declared by the Fixr; we do not independently verify every certification
• A Fixr's approval to use the platform does not imply our endorsement of the quality or safety of their work

You acknowledge that no vetting process eliminates all risk, and that you engage any Fixr at your own discretion and risk.

5. Customer Responsibilities

• Provide accurate, complete, and honest job descriptions, photos, and access details
• Ensure the job location is safe and accessible for the Fixr
• Treat Fixrs with respect and in accordance with applicable law
• Make payment for agreed work in full and on time
• Not attempt to engage a Fixr outside the platform to circumvent fees or protections

6. Fixr Responsibilities

• Provide accurate, honest quotes and complete accepted jobs to a professional standard
• Hold all licences, certifications, and registrations required by South African law for the trade performed
• Maintain their own public liability insurance where applicable
• Comply with all applicable legislation including the Occupational Health and Safety Act
• Not misrepresent their qualifications, experience, or identity
• Meet their own SARS tax obligations on earnings received through the platform

7. Payments

Payments are processed through Fixr's in-app payment system powered by PayFast. By making a payment, you also agree to PayFast's terms of service. Payments are held and released to the Fixr upon job completion as confirmed by the customer. Getfixr charges a platform commission on each completed job; this is deducted before the Fixr receives their payout.

Getfixr does not handle disputes relating to the quality of work as part of the payment process. Payment release is based on the customer confirming job completion, or the expiry of the review window, whichever occurs first.

8. Accidental Damage Cover (Optional Add-On)

Where a customer elects and pays for accidental damage cover, the following terms apply:

What is covered

• Accidental physical damage to the customer's property caused directly by the Fixr while performing the agreed job, up to the monetary limit displayed at time of purchase

What is not covered

• Personal injury, bodily harm, illness, or death of any person
• Damage caused by the customer's own negligence or actions
• Pre-existing damage or defects present before the job commenced
• Consequential loss, financial loss, or loss of use
• Intentional damage or fraud by either party
• Damage to third-party property
• Structural or latent defects resulting from completed work
• Any claim where photo evidence is unavailable or insufficient

Claims process

All claims are subject to review and investigation by Getfixr at our sole discretion. We may request before and after photos, chat records, job descriptions, and any other evidence we consider relevant. Submission of a claim does not guarantee approval. Our decision on any claim is final.

Accidental damage cover is not insurance. It is a discretionary protection offered by Getfixr and does not constitute a contract of insurance regulated by the Financial Sector Conduct Authority (FSCA). Getfixr reserves the right to withdraw or modify this offering at any time.

9. Prohibited Conduct

You may not use the platform to:

• Post false, misleading, or fraudulent job listings or quotes
• Harass, threaten, or abuse other users
• Circumvent the platform by arranging payment or repeat work outside Fixr
• Impersonate any person or entity
• Introduce malware, bots, or automated scraping tools
• Use the platform for any unlawful purpose

10. Disclaimers — No Warranties

To the maximum extent permitted by applicable law, the Fixr platform and all services accessible through it are provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that work performed by any Fixr will be of satisfactory quality, safe, complete, or fit for purpose
• Warranties that any Fixr holds valid licences, certifications, or insurance
• Warranties of uninterrupted or error-free operation of the platform
• Warranties relating to the accuracy of any Fixr profile, rating, or review

We expressly disclaim all responsibility for the conduct, acts, and omissions of Fixrs, both on and off the platform.

11. Limitation of Liability

To the maximum extent permitted by applicable South African law, Getfixr, its directors, employees, contractors, and affiliates shall not be liable for any:

• Personal injury, illness, death, or bodily harm arising from any job, whether or not the Fixr was vetted
• Damage to property, whether direct or indirect, arising from work performed by a Fixr
• Loss of income, loss of profits, or financial loss of any nature
• Indirect, consequential, incidental, special, or punitive damages
• Disputes, losses, or claims arising from transactions between customers and Fixrs
• Failure of any Fixr to perform, complete, or perform adequately any job
• Fraudulent misrepresentation by any Fixr or customer
• Unauthorised access to or breach of your account
• Platform downtime, data loss, or technical failures

Where liability cannot be fully excluded by law, our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the platform is limited to the lesser of: (a) the platform commission fees actually received by Getfixr in connection with the specific job giving rise to the claim; or (b) R500 (five hundred rand).

Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under the Consumer Protection Act 68 of 2008 or POPIA where those statutes apply.

12. Indemnification

You agree to indemnify, defend, and hold harmless Getfixr, its directors, employees, contractors, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the platform; (b) your breach of these Terms; (c) any job you post, accept, or perform; (d) your violation of any applicable law or third-party right; or (e) any dispute between you and another user of the platform.

13. Disputes Between Users

Getfixr is not a party to any dispute between a customer and a Fixr. If a dispute arises, you must attempt to resolve it directly with the other party. Getfixr may, at its sole discretion, offer limited assistance in facilitating communication but is under no obligation to mediate, arbitrate, or resolve any user dispute. Any dispute between users that results in legal proceedings is entirely between those parties; Getfixr shall not be joined to such proceedings.

14. Account Suspension and Termination

We may suspend or permanently terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, posed a safety risk, or if required by law. You may request deletion of your account at any time by contacting us.

15. Intellectual Property

All content on the Fixr platform — including the app, website, branding, code, and design — is owned by or licensed to Getfixr. You may not copy, reproduce, modify, or distribute any part of the platform without our written consent. By submitting content (photos, reviews, job descriptions), you grant Getfixr a non-exclusive, royalty-free licence to use that content to operate and improve the platform.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Gauteng, South Africa, unless a consumer protection statute requires otherwise.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented at checkout, constitute the entire agreement between you and Getfixr with respect to the platform and supersede all prior agreements and understandings.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the app or email. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
